Labour Regulation Acts Administered

The Office of Regulatory Services is the government agency responsible in the ACT for the administration of several Acts that provide workers with minimum conditions of service provisions involving annual leave, long service leave, and parental leave.
These are:

  • Annual Leave Act 1973
  • Long Service Leave Act 1976
  • Parental Leave (Private Sector Employees) Act 1992

Annual Leave

Entitlements to annual leave under the Annual Leave Act 1973 are affected by the Commonwealth's Workplace Relations Act 1996.  Information on entitlements under the workplace relations system is available at www.workplaceauthority.gov.au.

 

Long Service Leave

Three separate government agencies govern the long service leave schemes in the ACT.

  • The Office of Regulatory Services (ORS);
  • ACT Long Service Leave Authority (The Long Service Leave Board); and the
  • The Office of the Workplace Ombudsman (WO).

The Office of Regulatory Services (ORS)

ORS administers the Long Service Leave Act 1976.  The Act covers employees in the ACT private sector who are not covered by an industrial award or agreement, or in some cases, where an award or agreement does not contain provisions for long service leave.  The Act may also exclude workers that are employed in the cleaning and construction industry.

ACT Long Service Leave Authority (The Long Service Leave Board)

Employees that work in the ACT building, construction or cleaning industry are usually covered by the Long Service Leave (Building and Construction Industry) Act 1981, and the Long Service Leave (Contract Cleaning Industry) Act 1999, which are administered by the ACT Long Service Leave Authority or the Long Service Leave Board.

The Office of the Workplace Ombudsman (WO)

The Office of the Workplace Ombudsman (the “Workplace Ombudsman”) (WO) is an independent Commonwealth agency responsible for compliance with federal workplace law.  Most awards or agreements in the ACT are covered by the Workplace Relations Act 1996, which is administered by the WO.

Parental Leave

Entitlements to parental leave under the Parental Leave (Private Sector Employees) Act 1992 are affected by the Commonwealth's Workplace Relations Act 1996.  Information on entitlements under the workplace relations system is available at www.workplaceauthority.gov.au.
